The accused, Felipe Santiago, was charged with the crime of rape in Criminal Case No. 1048 before the Court of First Instance, Branch I, Nueva Ecija. The criminal complaint filed by Mabini Garcia in the said case reads as follows:

"That on or about the 26th day of May, 1975 in Cabanatuan City, Philippines, and within the jurisdiction of this Honorable Court, the above-named accused, by means of force or intimidation, did then and there, willfully, unlawfully and feloniously, have sexual intercourse with the undersigned complainant against the latter's will.
