REGALADO, J.:

With the imposition of the penalty of reclusion perpetua by the Court of Appeals on one of the herein accused-appellants in their appeal thereto, this case has been certified and the entire record thereof elevated to us in accordance with Section 13, Rule 124 of the 1985 Rules on Criminal Procedure.

Accused-appellants Francisco Arroyo, alias "Diotay," and Rito Mina, alias "Tano," were indicted for murder in an information 1 filed on August 30, 1988 alleging:

"That on or about July 10, 1988 in the morning thereof, at Tumalonton, Barangay Guibanwahan, Municipality of Balud, Province of Masbate, Philippines,...
