CARSON, J.:

Benito Siy Cong Bieng and Co Kong, the defendants in this action, were convicted in the court below of a violation of section 7 of Act No. 1655 of the Philippine Commission, known as the Pure Food and Drugs Act, and each of them was sentenced to pay a fine of P10 and one-half of the costs of the proceedings. From this judgment the defendant Benito Siy Cong Bieng alone appealed. The only error assigned by counsel for the appellant in his brief on this appeal is as follows:
