The petitioner, St. Gothard Disco Pub & Restaurant, is a single proprietorship owned and managed by the spouses Roland and Emily Werro at Fulton Street, Lahug, Cebu City. It has in its employ some thirty-nine (39) employees.

When typhoon "RUFING" hit Cebu City on November 13, 1990, it damaged the building where the St. Gothard Disco Pub & Restaurant was located. The electrical connection and the water supply to the establishment were cut off for several weeks resulting in stoppage of the business.
