Private respondent Lt. Col. Marcelino Malajacan was arrested on April 27, 1990 in connection with the December 1989 coup attempt. He was brought to the ISG Detention Center in Fort Bonifacio, Makati where he was detained for nine months without charges. On January 30, 1991, a charge sheet was filed against private respondent by the office of the Judge Advocate General alleging violations of the 67th, 94th and 97th Articles of War for Mutiny, Murder and Conduct Unbecoming an Officer and a Gentleman, respectively.
