PUNO, J.:

In order for conviction to lie, all the elements of the crime must be established beyond a reasonable doubt. In the case of murder, it is incumbent upon the prosecution to muster the evidence required by the Constitution to show not only that the unlawful killing was perpetrated by the accused, but also that any of the attendant circumstances that qualify it to murder exists. If it cannot be proven with moral certainty that at least one of the qualifying circumstances enumerated in Article 248 of the Revised Penal Code is present, the prosecution fails in its task, and the accused must be freed from liability...
