I respectfully dissent from the opinion of the majority written by Mr. Justice Santiago M. Kapunan, more particularly on the issue of the petitioner's qualification. 

Under Section 7, Subdivision A, Article IX of the Constitution, decisions, orders, or rulings of the COMELEC may be brought to this Court only by the special civil action for certiorari under Rule 65 of the Rules of Court (Aratuc vs. COMELEC, 88 SCRA 251 [1979]; Dario vs. Mison, 176 SCRA 84 [1989]). 

Accordingly, a writ of certiorari may be granted only if the COMELEC has acted without or in excess of jurisdiction or with grave abuse...
