D E C I S I O N

PANGANIBAN, J:

This Court is appalled at the unabated commission of heinous crimes in our country. Particularly disheartening is the high incidence of rape perpetrated day by day in urban and rural areas alike.

In this ponencia, the Court finds occasion to clarify existing jurisprudence on the grant of damages in the crime of rape, which is likewise applicable to the crimes of murder, homicide and parricide. Civil indemnity in the amount of P50,000.00 (consistent with prevailing jurisprudence) is automatically granted to the offended party, or his/her heirs in case of the former's death, without need of further evidence...
