As a general rule, the factual findings of trial courts deserve respect and are not disturbed on appeal, unless some facts or circumstances of weight and substance have been overlooked, misapprehended or misinterpreted, and would otherwise materially affect the disposition of the case. 51 This rule, however, does not apply when the judge who penned the decision was not the same one who had heard the prosecution witnesses testify, 52 as in the present case.
