TRENT, J.:

This is action of quo warranto instituted by Gregorio Remata against Juan Javier for the purpose of ousting the latter from the office of municipal president of Candelaria, Province of Tayabas, and placing the plaintiff in possession of the same.

The grounds upon which the action is based, according to the complaint, are that Juan Javier was duly elected president, qualified and assumed the office in 1912, and that his term expired by operation of law on October 15, 1916.
