When appellants raise factual issues, they must use cogent and convincing arguments to show that the trial court erred in appreciating the evidence. Whenever the credibility of witnesses and their testimonies is raised as the core issue, reviewing courts necessarily rely on the assessment thereof by the trial judge. This is because he was in the best position to observe the witnesses firsthand and to note their demeanor, conduct and manner of testifying.
