This case is brought to this court by appeal from a judgment of the Court of First Instance of the Province of Iloilo convicting the defendant upon the charge of frustrated murder.

There is no doubt that an assault with intent to kill was committed by the defendant at the time and place mentioned in the record upon the person of his querida; but the proof shows, in our opinion, that the defendant was crazy at the time and has remained so since. He has now been committed by order of the Governor-General to the San Lazaro Hospital for confinement and treatment. The trial judge says, "I really believe that this...
