D E C I S I O N


KAPUNAN, J.:

"The declaration of a dying person, made under a consciousness of an impending death, may be received in any case wherein his death is the subject of inquiry, as evidence of the cause and surrounding circumstances of such death."1 [Section 37, Rule 130 of the Rules of Court.] The application of the said exception to the hearsay rule is the subject of the Court's scrutiny. Here, the victim allegedly made an ante mortem statement naming the appellants as his assailants and the trial court convicted the appellants solely on account of the said dying declaration.
