GONZAGA-REYES, J.:

This is an appeal from the Decision[1] dated March 02, 1999 of the Regional Trial Court of Cebu City, Branch XXIV, in Criminal Case No. CBU-43218, finding accused Jomer Cabansay y Palermo, alias "Omi", guilty beyond reasonable doubt of the crime of Murder and sentencing him to suffer the penalty of Reclusion Perpetua.

On January 24, 1997, accused was charged with the crime of Murder in an Information that reads, thus:
