JOHNSON, J .:

On the 24th day of January, 1917, the prosecuting attorney of the Province of Laguna presented a complaint in the Court of First Instance of said province in which the defendant was charged with a violation of the Gambling Law (Act No. 1757). The complaint alleged:

"That in and beginning from the month of November, 1913, up to the month of May, 1914, in the municipality of Paete, Province of Laguna, P. I., the accused Eugenio Baguio, wilfully, unlawfully and maliciously was conducting operating and taking part, and did so conduct, operate and take part, in the prohibited game of chance called 'loteria,'...
