MENDOZA, J.:

This is an appeal from the decision,[1] dated August 19, 1999, of the Regional Trial Court, Branch 44, Dumaguete City, Negros Oriental, insofar as it finds one of the accused, Benny Acosta, guilty of murder and sentences him to suffer the penalty of reclusion perpetua and to pay the amount of P50,000.00 as civil indemnity for the death of Norton Baguio.

The facts are as follows:
