QUISUMBING, J.:

On appeal is the decision rendered on June 19, 1997, by the Regional Trial Court of Tarlac, Tarlac, Branch 65, in Criminal Case No. 8753, finding appellant Restituto Cabacan y Mendoza guilty of murder. In said decision the trial court decreed:

WHEREFORE, the Court finds the accused Restituto Cabacan y Mendoza GUILTY beyond reasonable doubt of the crime of murder as defined and penalized under Article 248 of the Revised Penal Code, as amended, and there being no aggravating circumstance or in mitigation thereof, he is hereby sentenced to suffer the penalty of reclusion perpetua, with the accessory penalty...
