The purpose of an action or suit and the law to govern it, including the period of prescription, is to be determined by the complaint itself, its allegations and prayer for relief.[1] Thus, while the issues of possession and fraud are material to the prescriptibility of suits captioned as reconveyance and quieting of title,[2] it would not be so where, from the allegations of the complaint, the action is in reality one for declaration of nullity of contracts on the ground of absence of the essential requisites thereof.
