These are two consolidated petitions assailing the Resolutions of the Court of Appeals in CA-G.R. CR No. 23309, dated May 7, 2001[1] and February 14, 2002.[2]

Respondent Wilfred N. Chiok was charged with estafa in Criminal Case No. 109927, filed by private complainant Rufina Chua. On February 1, 1999, the Regional Trial Court of Pasig, Branch 165, rendered judgment convicting respondent of the crime charged.
