QUISUMBING, J., Dissenting:

I respectfully differ from the majority of my brethren on this case.  I vote to sustain the decision[1] dated March 8, 2000, the Regional Trial Court of Davao City, Branch 17, which convicted in Criminal Case No. 43,817-99 appellants Noel Tudtud y Paypa and Dindo Bolong[2] y Naret, and imposed upon each of them the penalty of reclusion perpetuaand a fine of P500,000, for illegal possession of prohibited drugs.
