MALCOLM, J.:

The fundamental question in this case is whether or not the amended complaint filed in the Court of First Instance of Albay, on February 2, 1920, states a cause of action. Judge Mina, of the Court of First Instance, held that it did not, and, accordingly, sustained the demurer, and dismissed the action, with costs against the plaintiff. Said complaint reads as follows:
