Assailed in this petition for review under Rule 45 of the Rules of Court is the decision[2] of the Court of Appeals dated March 30, 1999 which affirmed in toto the decision of the Regional Trial Court of Ozamis City, Branch 15, dated June 14, 1988. 

At the center of this controversy is Lot 434, a parcel of land located in Ozamis City formerly covered by Original Certificate of Title (OCT) No. 428 and registered under the names of Ramon Daomilas and Lucia Nagac, the parents of respondent Sister Lucia Ancilla.
