In its Decision[1] dated 27 October 2004, the Regional Trial Court (RTC), Branch 32 of Agoo, La Union, in Criminal Case No. A-2871, found appellant Bernard Mapalo guilty beyond reasonable doubt of the crime of Murder, and imposed upon him the penalty of reclusion perpetua. On appeal, the Court of Appeals rendered a Decision[2] dated 21 November 2005, modifying the Decision of the RTC, and finding Bernard Mapalo guilty beyond reasonable doubt of the crime of Frustrated Murder.
