This is an appeal by certiorari under Rule 45 of the Rules of Court seeking to nullify and set aside the decision of the Court of Appeals (CA) dated August 30, 2004[1] and its amended decision of November 30, 2004[2] in CA-G.R. SP No. 75359 and CA-G.R. SP No. 75366.
