Before this Court for automatic review is the Decision[1] of the Court of Appeals in C.A. G.R. CR. H.C. No. 00339 promulgated on September 29, 2005, affirming the Decision[2] dated September 9, 2002 of the Regional Trial Court (RTC) of Baler, Aurora, Branch 66 in Criminal Case No. 2052, finding appellant Francisco Buban guilty beyond reasonable doubt of the crime of murder qualified by treachery, with the aggravating circumstances of evident premeditation and dwelling, without any mitigating circumstance, and sentencing him to suffer the supreme penalty of death.
