Before Us is a Petition for Review[1] on Certiorari under Rule 45 of the Rules of Court seeking to set aside the Decision,[2] dated 20 December 1995, of the Court of Appeals in CA-G.R. CV No. 26921 which affirmed in toto the Decision,[3] dated 2 April 1990, of the Quezon City Regional Trial Court (RTC), Branch 90, in Civil Case No. Q-33893.

The undisputed facts are as follows:
