JOHNSON, J.:

It appears from the record that on or about the 16th day of August, 1926, a complaint was presented against the defendant in the court of the justice of the peace of the municipality of Malabon, Province of Rizal, by the mother of the offended person, accusing the defendant of the crime of rape. Upon that complaint the defendant was arrested and given a preliminary examination, at the close of which the justice of the peace found that there was probable cause for believing that the defendant was guilty of the crime charged, and held him for trial in the Court of First Instance of the Province of Rizal.
