This is an appeal from the Decision[1] dated September 30, 2009 of the Court of Appeals (CA) in CA-G.R. CR-H.C. No. 03388 affirming with modification the Decision[2] of the Regional Trial Court (RTC) of Lagawe, Ifugao, which adjudged appellant Basilio Cadap guilty beyond reasonable doubt of statutory rape.

In an information filed before the RTC of Lagawe, Ifugao, thereat docketed as Crim. Case No. 1658 and eventually raffled to Branch 14 of the court, Cadap was charged with statutory rape, allegedly committed as follows:
