For review is the Decision[1] dated 14 March 2008 of the Court of Appeals in CA-G.R. CR-H.C. No. 02236, which modified the Decision[2] dated 8 November 2005 of the Regional Trial Court (RTC) of Legazpi City, 5th Judicial Region, Branch 9, in Criminal Case No. FC-00-319, finding herein appellant Roy Alcazar y Miranda guilty beyond reasonable doubt of qualified statutory rape under Article 266-A of the Revised Penal Code, as amended, in relation to Article 266-B of the same Code, committed against AAA[3] and imposing upon him the supreme penalty of death.
