NATIVIDAD, J.:

The accused, Sisenando Francisco, was charged in the Court of First Instance of Manila with the crime of abandonment. After trial, the lower court found him guilty of the crime charged, and pursuant to the provision of Article 277 of the Revised Penal Code, sentenced him to one month and one day of arresto mayor and to pay a fine of P100, with subsidiary imprisonment in case of insolvency, and to pay the cost. From this judgment, he appealed.
