On appeal from a judgments of the Cebu City Municipal court convicting appellant of estafa.

Prior to April, 1959, Felisa Ortiz, estranged wife of Floro Ortiz, met defendant Bonifacio Constantino. She moved into the latter's house in Talisay, Cebu. She worked as a seamstress in the shop of Brigido Nacua in Cebu City where she used her sewing machine valued at P475.00. On April 20, 1959, she discovered her machine was gone. It developed that on the day previous, defendant took it away, sold it to Mamerto Cabahug in Mandawe.
