Before us is a Petition for Review under Rule 45 of the 1997 Rules of Civil Procedure assailing the Decision[1] and Resolution[2] of the Court of Appeals (CA) dated 3 September 2007 and 18 July 2008, respectively, in CA-G.R. SP No. 93368, affirming the Decision of the Regional Trial Court (RTC),[3] dated 18 January 2006, in Civil Case No. 05-112499, which reversed the ruling of the Metropolitan Trial Court (MeTC) on the ground that the MeTC did not acquire jurisdiction over the person of the respondents due to invalid service of summons.
