The Case
 
Before Us is a Petition for Review on Certiorari under Rule 45 of the Rules of Court assailing the September 28, 2011 Decision[1] and February 13, 2012 Resolution[2] of the Court of Appeals (CA) rendered in CA-G.R. CV No. 91424. Said rulings dismissed petitioner Metropolitan Banking and Trust Company's (MBTC's) claim for deficiency payment upon foreclosing respondents' mortgaged properties and ordered the bank, instead, to return to respondent mortgagors the excess amount of PhP 722,602.22.
