DISSENTING OPINION


CAGUIOA, J.:

I vote to acquit accused-appellant Ryan Maralit y Casilang.

Firstly, the prosecution failed to prove that there was a consideration for the alleged sale of dangerous drugs. Secondly, the apprehending officers failed to comply with the requirements of Republic Act No. (RA) 9165,[1] in the seizure and handling of the seized drugs. The prosecution also failed to present justifiable grounds for such non-compliance. In view thereof, the integrity and evidentiary value of the corpus delicti had been compromised.[2]
