Failure to comply with the chain of custody requirements in drugs cases will result in an accused's acquittal.

This resolves an appeal of the October 9, 2015 Decision[1] of the Court of Appeals in CA-G.R. CR-H.C. No. 05992, which affirmed the Regional Trial Court January 22, 2013 Decision.[2] The trial court convicted accused-appellant Dioscoro Comoso y Turemutsa (Comoso) for violation of Article II, Section 5 of Republic Act No. 9165, or the Comprehensive Dangerous Drugs Act of 2002.
