In order for a superior public officer to be made civilly liable for acts done in the performance of his official duties, there must be a clear showing of bad faith, malice, or gross negligence. For negligence to be considered gross, there must be an act or omission to act in a situation where there is a duty to act, not inadvertently but willfully and intentionally with a conscious indifference to consequences in so far as other persons or the government may be affected.
