PERFECTO, J., concurring: 

Before September 14, 1939, Haw Pia secured an overdraft account from the China Banking Corporation up to the sum of P8,000 with the obligation to pay, on the bank's demand, the amounts withdrawn with interest at the rate of 9 per cent per annum, payable monthly, at the end of each month, the interests to be compounded in case of failure. 

From September 14, 1939, to December 26, 1941, plaintiff withdrew several amounts and on a later date the balance amounted to P5,103.35. 

On September 14, 1941, plaintiff mortgaged to defendant, as guaranty for the amounts of her indebtedness...
